2. Nature of the Service

Wink3r is a social-dating platform for adults. Users may upload their own photos, videos and other materials ("User Content").

The Operator provides hosting and related interactive computer services. The Operator does not produce, commission, or direct User Content and is not the creator of that material.

3. Exemption for user-generated content

With respect to User Content, the Operator is not a "primary producer" or "secondary producer" within the meaning of 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75.

Records required by those statutes for sexually explicit depictions, where they apply, are maintained by the individual users who created and uploaded the content, as the producers of that content. The Operator does not collect government identity documents for User Content and does not keep a 2257 age-record file on behalf of users.

By posting Content, each User represents and warrants that:

  • every person depicted is 18 years of age or older
  • the User has all rights and consents needed to publish the Content
  • the User is the producer of that Content for record-keeping purposes, where those laws apply

The Operator may remove Content, restrict accounts, and report illegal material, including any suspected involvement of minors. Child sexual abuse material is strictly prohibited.

4. Content produced by the Operator

For any sexually explicit visual material that the Operator itself produces (for example branded promotional media created by the Operator, if any), the Operator will maintain the records required by 18 U.S.C. §§ 2257 and 2257A.
